1. Acknowledgment

These Terms of Service (“Terms”) govern your access to and use of the website ath.estate and any related service provided by Athestate I.K.E., a private company registered in Athens, Greece (“Athestate”, “we”, “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

2. The Service

Athestate I.K.E. (Private Company — GEMI No. 195247401000, incorporated 23/07/2026, Managers: Mirwann Frederic Mou Abi Farah and Triantafyllia Karava) is a real-estate brokerage and advisory firm registered in Athens, Greece — AFM (VAT) 803357033, NACE 6619/6820/6831. Our services include:

  • Real estate brokerage for properties in the Attica region (Athens, Athens Riviera, suburbs)
  • Golden Visa investment advisory (Greek Law 4251/2014, as amended)
  • Relocation and settling-in services
  • Property management
  • Investment advisory

3. Eligibility

You must be at least 18 years old and legally capable of entering into contracts under Greek law to use our Service. By using the Service, you represent and warrant that you meet these requirements.

4. User Obligations

You agree to:

  • Provide accurate, current, and complete information when contacting us
  • Maintain and promptly update your information
  • Use the Service for lawful purposes only and in accordance with Greek and EU law
  • Not engage in fraudulent, misleading, or illegal activity, including money laundering
  • Cooperate with our AML/KYC verification (identity documents, source of funds) as required by Law 4557/2018

5. Greek Real Estate Specifics

Real estate transactions in Greece are subject to specific legal requirements, including:

  • Notarial deed: Property transfers in Greece require a notarial deed signed before a Greek notary (Art. 946 & 947 of the Greek Civil Code). The notary verifies title, encumbrances, and identity.
  • Hellenic Cadastre registration: Transfer of title is registered with the Hellenic Cadastre.
  • Transfer tax: Acquisition of property is subject to a one-time transfer tax (typically 3.09% of the cadastral value, as set by the Independent Authority for Public Revenue (AADE)).
  • ENFIA (annual property tax): Property owners pay annual ENFIA to the Greek State.
  • AFM (Greek tax number): Non-EU buyers must obtain an AFM before acquiring property.

We strongly recommend that all buyers engage a Greek notary and an independent lawyer before signing.

6. Brokerage Agreement & Commission

Engagement of Athestate as your broker is subject to a separate written brokerage agreement in accordance with Greek law. Commission is typically:

  • Buyer side: typically 2% to 5% of the purchase price (+ VAT 24%), depending on the property and the agreement
  • Seller side: as agreed in the exclusive or non-exclusive listing agreement

All commissions are subject to Greek VAT (24%) and must be invoiced in compliance with Greek tax law.

7. Consumer Protection & Right of Withdrawal

In compliance with Greek consumer protection law (Law 2251/1994) and EU Directive 2011/83/EU on consumer rights:

  • You have a 14-day right of withdrawal from any service contract signed off-premises (at our office or at your location) or remotely (email, phone, video), without giving any reason
  • The 14-day period starts the day after the contract is signed
  • To exercise this right, you must inform us by email at contact@athestate.com before the 14-day period expires
  • If you requested services to begin before the end of the withdrawal period, you may be charged a proportional fee for services already rendered

This right does NOT apply to services fully performed before the withdrawal period expires, or to property purchase agreements (which are governed by Greek property law).

8. Property Listings

All property listings, prices, areas, and availability are indicative and based on information provided by sellers. They are subject to change without notice. Final terms (price, conditions, completion date) are agreed only in the binding purchase agreement signed before a Greek notary. We do our best to verify listing accuracy but recommend independent due diligence.

9. AML / KYC Compliance

In compliance with Greek Law 4557/2018 (transposing EU 5AMLD) and the Hellenic Capital Market Commission guidance, we are required to:

  • Verify the identity of all clients (passport or Greek ID)
  • Verify beneficial ownership
  • Collect proof of address and source of funds
  • Report suspicious transactions to the Hellenic Financial Intelligence Unit (FIU)

Refusal to provide AML/KYC documents will result in the termination of the business relationship.

10. Golden Visa Advisory

Our Golden Visa advisory service provides information on the requirements of Greek Law 4251/2014 (as amended) and related ministerial decisions. We do not provide legal advice. Final eligibility decisions are made by the Hellenic Ministry of Migration & Asylum. Investment requirements, processing times, and benefits may change without notice.

11. Intellectual Property

All content on this website — text, graphics, logos, images, photographs — is the property of Athestate or its licensors and is protected by Greek copyright law (Law 2121/1993) and EU directives. Reproduction or distribution without prior written consent is prohibited.

12. Third-Party Links

Our website may contain links to third-party websites, including Greek government sites (Hellenic Cadastre, AADE, Ministry of Migration, EFKA). These are provided for convenience only. We are not responsible for the content, accuracy, or practices of such third-party sites.

13. Limitation of Liability

To the maximum extent permitted by Greek law, Athestate shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Service. Our total liability for any claim shall not exceed the fees actually paid by you to Athestate in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability for fraud, death, or personal injury.

14. Indemnification

You agree to indemnify and hold Athestate, its directors, and employees harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these Terms or your use of the Service.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for breach of these Terms. Upon termination, provisions that by their nature should survive will do so.

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Hellenic Republic (Greece), without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.

Consumers may also rely on the mandatory provisions of the law of their country of residence if more protective.

17. Dispute Resolution

Before initiating litigation, you may contact us at contact@athestate.com to seek an amicable resolution. Consumers may also use the European Commission’s Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

18. Language

These Terms are provided in English. In case of any conflict between the English version and any translation, the English version prevails.
